DIVORCE REGISTRATION (rikon todoke)
There are four types of divorce procedures in Japan. These are:
- uncontested divorce (kyogi rikon)
- divorce by arbitration (chotei rikon)
- divorce by court decision (shinpan rikon)
- divorce by court trial (saiban rikon)
Uncontested divorce means that the married partners mutually agree to divorce and the marriage is legally terminated.
Divorce by arbitration takes place when the married partners cannot come to a mutual agreement and third party arbiters are called in to mediate the case and reach a divorce settlement.
Divorce by court decision means that a settlement cannot be reached by mutual agreement through mediation and a judge (shinpan in) is called in to hear the arbiters opinions after which time a decision is pronounced.
Divorce by court trial means just as it says, a formal trial is conducted in Family Court after which time the judge (saiban cho) makes a divorce pronouncement.
Divorce proceedings other than uncontested divorce must all be applied for through the Family Court. For further information regarding such divorce proceedings, please contact the Family Court.
In the case of uncontested divorce, the divorcing parties must complete the divorce registration form, including the signatures of two witnesses who are age 20 or older, sign and seal the form and submit it to the Citizens Affairs Division on the first floor of Kiryu City Hall.
Note: Some countries do not recognize uncontested divorce in Japan. Please consult with the Embassy or consular office of your country of citizenship.
